Website & Digital Privacy Policy

Effective Date: November 28, 2025

This Privacy Policy describes how Stillwaters Assessment & Neuropsychological Services, PLLC (the “Practice,” “we,” or “us”) collects, uses, and protects the non-health-related personal information and technical data of visitors and users of our website, located at swansfl.com, and any related public digital platforms (such as external scheduling links or social media profiles).

Crucial Distinction: This document does NOT apply to your Protected Health Information (PHI). Information regarding your PHI, your patient rights, and our legal duties under the Health Insurance Portability and Accountability Act (HIPAA) is governed by our separate Notice of Privacy Practices (NPP), which is also available via our website: Notice of Privacy Practices

1. Information We Collect

We only collect non-health-related information from website visitors for the purposes described below.

  • Information You Voluntarily Provide (via External Secure Links): This includes information you choose to submit to us when leaving the public website to use a secure, third-party communication platform (e.g., a secure client portal link, or an encrypted contact form service). The data collected on these platforms is treated as PHI and is protected by our NPP, but the link/referral itself is tracked by our website.
  • Non-PHI Administrative Information (via Public Email): This includes non-clinical information you submit via public email links provided on the website.
Examples: Your name, email address, phone number, and any general, non-clinical administrative messages you send.
  • Technical and Usage Data: Information collected automatically when you visit our website. This data is not linked to your identity or your status as a patient.
Examples: Internet Protocol (IP) address, browser type and version, device type, operating system, pages visited, time spent on pages, and referring website addresses.

2. How We Use the Collected Information

The non-PHI information collected under Section 1 is used exclusively for website function, security, and administrative operations:

  • Respond to Inquiries: To respond to your non-clinical, general administrative questions and requests for information submitted via public email.
  • Website Analytics: To monitor and analyze website traffic, improve user experience, and optimize the performance of our site.
  • Security and Maintenance: To protect the security of our website and digital assets, including protecting against malicious or unauthorized activity.

3. Social Media and Electronic Communication Boundaries

This section establishes the strict professional boundaries required to protect your confidentiality and comply with ethical and legal standards when interacting with the Practice on public platforms.

  1. No Clinical Communication on Social Media
We strictly prohibit the use of social media messaging (e.g., Facebook Messenger, Instagram DMs, comments, or public posts) for any communication related to your clinical care, scheduling, administrative questions, or psychological concerns.
    • Social media platforms are not secure or confidential. Messages sent through these platforms are not HIPAA-compliant and pose a risk to your privacy.
    • No Therapeutic Relationship: Communicating with us via social media does not constitute a professional relationship, and we cannot offer psychological advice or services through these channels.
    • Redirection: All clinical, scheduling, and PHI-related inquiries must be directed to our secure phone number or secure client portal links, as provided on the website.
  2. Friending, Following, and Public Interaction
To protect your privacy and maintain ethical professional boundaries:
    • We do not accept “friend” or “follow” requests from current or former clients on any personal social media profiles.
    • We cannot reply to comments or questions on our public profiles that may reveal your status as a client. If you choose to comment on our public posts, you assume the risk of revealing your association with the Practice.

4. Cookies and Tracking Technologies

Our website uses standard tracking technologies, such as cookies (small data files placed on your device) and analytics tools (like Google Analytics), to enhance functionality and gather non-identifying usage data.

  • These technologies DO NOT track, collect, or store your Protected Health Information (PHI).
  • You can set your browser to refuse all or some browser cookies, but doing so may affect the functionality of our website.

5. Disclosure of Website Information

We do not sell any non-PHI personal information collected from our website visitors. We may disclose the non-PHI information described in Section 1 to:

  • Service Providers: Third-party vendors who perform website hosting, maintenance, or analytics services on our behalf, and who are contractually obligated to keep the information confidential.
  • Legal Requirements: When required to do so by law, court order, or government regulation, including to comply with the Florida Information Protection Act (FIPA) breach notification requirements.

6. Protection of Non-PHI Data

We implement reasonable administrative, technical, and physical safeguards to protect the non-PHI personal information we collect through our website against unauthorized access, disclosure, or misuse.

7. External Links

Our website may contain links to external sites, such as professional organizations or other providers. We are not responsible for the content or privacy practices of these third-party websites. We encourage you to review their policies.

8. Your Digital Privacy Rights

Depending on where you reside, you may have specific rights regarding the non-PHI personal data collected by this website.
